NIA court refuses bail to Tafazul Hussain Parimoo after nearly six years in detention under UAPA with case still unproven

A special NIA court in Jammu has rejected the bail application of Kashmiri freedom activist Tafazul Hussain Parimoo, who has been held in custody since October 2020, nearly six years, on charges under the Unlawful Activities Prevention Act. His counsel argued that no arms had been recovered from him and that only 23 of approximately 150 prosecution witnesses had been examined across nearly six years of detention. The NIA opposed bail, alleging Parimoo was an active over-ground worker. The court dismissed the application, stating that the principle of bail as the rule and jail as the exception does not apply with equal force under the UAPA, and expressing concern that Parimoo could influence witnesses or tamper with evidence if released.
Kashmir Conflict states what this ruling documents. A man has been imprisoned for nearly six years. The prosecution has examined fewer than one sixth of its own witnesses in that time. No arms were recovered from him. The court has now ruled that he must remain imprisoned because he might influence witnesses in a case the prosecution has spent six years failing to adequately present. The UAPA does not require evidence before detention. The court has confirmed today that it does not require progress either. National security, the court states, cannot be compromised. Tafazul Hussain Parimoo's liberty, apparently, can be. Indefinitely. On allegations that have not been proven in six years of trying.
